'WIN KENDAL CALLING TICKETS' PROMOTION CONDITIONS OF ENTRY
Terms & Conditions Summary
- The Prize are 2 tickets to Kendal Calling, Travel across UK to a maximum of £100, Car park tickets to a maximum of £40, Gift Voucher redeemable at www.boohoo.com to the value of £100
- The competition is open to all UK residents over 18, except employees of Boohoo.com and any companies involved in the administration or promotion of this Prize Draw.
- The closing date for receipt of entries is midnight Sunday 21st July 2013 (GMT). The Winner will be contacted on Monday 22nd July 2013.
- The winning entry will be picked from twitter answers posted and it will be judged on the best answer for 'why they should win' using hashtag #bohoovip from all posts as judged by the boohoo team.
- Wasabi Frog's decision as to the winning entry is final – no correspondence will be entered into.
- The festival tickets will be posted to the Winner.
- The winner needs to arrange their own travel and parking which will then be reimbursed.
- The Winner must redeem their gift vouchers by opening an account at www.boohoo.com, so that it can be credited with the Prize.
- The Prize is not redeemable for cash or resale.
Terms & Conditions
By entering into this prize draw competition, entrants shall be deemed to have read and accepted these terms and conditions ("Terms") and agree to be bound by them. If you do not agree with any of these Terms please do not enter into the competition.
The competition is operated by Wasabi Frog Limited t/a boohoo.com with registered number 05723154 and registered address 49/51 Dale Street, Manchester, M1 2HF. References in these Terms to "us", "we" and "Boohoo" are to Wasabi Frog Limited.
1.1 Entrants must meet the eligibility requirements set out in this paragraph 1. Failure to meet the eligibility requirements may result in an entry being invalid and/or forfeiture of the Prize. 1.2 Entrants must be aged 18 years or over at the time of entering the competition. 1.3 Entrants must be resident in the UK. 1.4 Employees and personnel of Boohoo or any other company connected with the operation of the competition and each of their subsidiaries, members or their group of companies and associated companies, and the families, friends or agents of such employees or personnel, are ineligible to enter the competition. 1.5 Entrants must have their own active personal Twitter account.
2.1 In order to enter the competition, the entrants must tell us why they should be the lucky winner of the tickets by tweeting an answer to @boohooofficial with the hashtag '#boohoovip'. Any attempted form of entry other than as described in these Terms is void. 2.2 Entries can only be made between Friday 19th July 2013 and midnight (GMT) on 21st July 2013 ("Closing Date"). 2.3 The winner will be announced on Monday 22nd July 2013. 2.4 There is a maximum of one entry per person. No purchase necessary. No bulk, third party or automated entries permitted. 2.5 Entrants are responsible for timely receipt of entry. Boohoo, its agents and employees are not responsible for any incomplete, lost, delayed or late entries. 2.6 This Promotion is a game of skill. Chance plays no part in determining the winners.
3.1 The total Prize Pool for this competition is valued at up to £460. There is one (1) prize in total. 3.2 The prize for winning the competition is two (2) tickets to Kendal Calling. The prize includes the below provided by Boohoo to the winner pursuant to paragraph 4.3 below and their travel companion, two (2) tickets to the Kendal Calling Festival (valued at up to £230 for 2 people), travel contribution up to the value of 100 to the event, car park tickets worth £40 and a £100 boohoo voucher for the winner ("Prize"). No cash or other alternative is available. 3.3 No responsibility is accepted for any variation in the value of the prizes. 3.4 The Prize cannot be sold, transferred or otherwise disposed of or given to any other person or company. 3.5 The Prize does not include food and drink, travel insurance, personal expenditure or incidental costs. 3.6 It is the winner's responsibility to ensure that they and their travel companion are available to attend on these days and have a valid passport or identification and travel insurance. 3.7 The Prize must be taken between 22nd July 2013 and Thursday 25th July 2013.
4.1 There will be just one winner of the Prize. 4.2 Judging will take place within 1 day of the Closing Date at 49/51 Dale Street, Manchester, M1 2HF. The judges will select the Prize Winner based on the creativity and originality of the answers. The Winner will be contacted via email on Monday 22nd July 2013. 4.3 The winner and their travel companion will be asked to arrange their own travel between the winner's home and the festival and provide a receipt of payment (electronic or printed) to Boohoo who will then reimburse the travel cost via bank transfer. 4.4 Car park tickets are not included within the price of the festival tickets. If traveling by car, the winner must pay for car park tickets themselves which can either be made online in advance (£6 per day) or on the day (£10 per day). Boohoo will only reimburse parking for 1 car up to the value of £40 (4 days). The winner must provide a receipt of payment (printed or electronic) to Boohoo who will then reimburse the car park tickets cost via bank transfer within the next 7 days. 4.5 Boohoo will post the Prize (2 tickets to Kendal Calling) to the winner. Alternatively, the winner will be able to pick the Prize on the day at the Kendal Calling ticket box office. 4.6 If the winner is not contactable within 2 days of the Closing Date after reasonable means (using the contact details provided by the entrant), or fails to meet any of the eligibility requirements set out in paragraph 1 above, or is unable to provide the details or documents requested by Boohoo under paragraph 4.3 above, or is otherwise unable to comply with these Terms, Boohoo reserves the right to award the Prize to an alternative winner, selected in accordance with these Terms. 4.7 By entering into the competition, the winner agrees to participate in publicity following the competition. This may include use of their name and image in online and offline publicity, communications, and in any other media worldwide without any fee being paid to the winner. 4.8 For the name of the winner, please send an SAE to Kendal Calling Festival Competition c/o Boohoo Marketing, 49-51 Dale Street, Manchester, M1 2EQ within four weeks of the Closing Date.
5.1 To the extent permitted by law, Boohoo and its agents and representatives hereby expressly exclude any liability whether in contract, tort, breach of statutory duty or otherwise for any direct, indirect or consequential loss, damage, injury or disappointment (including without limitation any pure economic loss) suffered or incurred by any entrant, winner or any third party whether foreseeable or not in connection with:
(a) any act or omission of Boohoo in developing, planning and administering this competition; (b) any entry or attempted entry into this competition; or (c) any accident, incident, delay or disruption arising in connection with the Prize.
5.2 Boohoo will not be liable for any inability of any person to enter the competition because of any unavailability of Twitter, or failures in or unavailability of computer systems or networks, other malfunctions, or for any other reason. 5.3 All conditions, warranties and other terms which might otherwise be implied by statute or common law are expressly excluded from these Terms. 5.4 Nothing in these Terms shall exclude or limit Boohoo's liability for death or personal injury caused by its negligence or for fraud or fraudulent misrepresentation. 5.5 The winner agrees to indemnify and keep indemnified Boohoo, its group of companies and their officers, employees and agents from and against all liabilities, losses, damages and expenses (including legal and other professional fees) arising out of or in connection with any allegations or claims resulting directly or indirectly from:
(a) their entry into this competition; (b) their receipt and use of the Prize.
5.6 Boohoo will fully co-operate with any law enforcement authorities or court order requesting or directing Boohoo to disclose the identity of or to locate anyone posting or linking any content to the Boohoo Facebook Page which infringes any third party rights or is in breach of any of these Terms.
6.1 Boohoo may refuse to provide the Prize in the event that an entrant fails to satisfy the eligibility requirements under these Terms, or has committed or is alleged to have committed any act of fraud or dishonesty, or is in breach of any of these Terms. 6.2 Any entrant and/or winner must comply with any directions given to him or her by Boohoo. Failure to comply with such directions may result in an invalid entry and/or forfeiture of the Prize. 6.3 Boohoo reserves the right to cancel or amend the competition or these Terms without notice if it has reasonable grounds for doing so which may include without limitation the competition (or the website on which it is operated) being affected by any denial-of service attacks, viruses, hacking or any other technologically harmful material or act. [Boohoo reserves the right to substitute the Prize including the accommodation for one of equivalent or greater value if the flights to and/or accommodation becomes unavailable for any reason outside of Boohoo's reasonable control.] Any changes to these Terms or the Prize will be posted on the website www.boohoo.com. 6.4 In the event of any dispute regarding these Terms, conduct, results and all other matters relating to the competition, the decision of Boohoo shall be final and no correspondence or discussion shall be entered into. 6.5 If any provision of these Terms (or part of any provision) is found by any court or other competent authority to be invalid, unenforceable or illegal, the other provisions shall remain in force. If any invalid, unenforceable or illegal provision would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with whatever modification is necessary to give effect to the commercial intention of the parties. 6.6 No failure or delay by a party to exercise any right or remedy provided under these Terms or by law or any abandonment of any such right or remedy shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy. 6.7 These Terms and any non-contractual obligations arising out of or in connection with them shall be governed and construed in accordance with English law.
