UK Returns - How do I return my order?

boohoo returns are FREE & easy!

First, repack the item with all the tags still attached.
Login here to select your item(s) for return.
Choose one of our trusted carriers, print your returns label , then post it off!
Make sure you get proof of postage and keep it safe!

What's your returns policy?

If you need to return something, make sure all the tags are on, and the item is exactly as you received it. You need to get it back to us within 14 days from the date on your dispatch note. For those in Australia, New Zealand, America or Canada, you've got 28 days from the date on your dispatch note. For hygiene reasons, pierced jewellery is non-refundable, and we ask that you try on swimwear and lingerie over your own underwear and keep the seal in tact.

What should I do if I`ve forgotten to use my promotional code?

Unfortunately, we are unable to manually enter discounts after the order has been completed.

Do I have to order online?

Yes, as we are an online retailer you can only order online. This is the best way to pay. It is fast, safe and secure.

How can I pay for my order?

We accept the following payment cards: Visa, Visa Debit, MasterCard, Solo, Maestro, Electron and American Express. We also accept PayPal, Ideal, Giftcards and prepaid debit cards.

Is it safe to order online?

You can be assured that shopping with boohoo is safe! We are a member of "Verified by Visa" and "Secure by Mastercard", providing additional security when using your payment cards online. We use industry-standard encryption systems for potentially sensitive information, such as your name, address and other critically sensitive information like your credit / debit card details. Information passed between your computer and our website cannot be read in the event of someone else intercepting it.

How do I know that you have received my order?

Once you've placed your order, you will be directed to an order confirmation message, which will contain your order number. This information will also be emailed to you, but it could take up to 30 minutes to arrive in your inbox! Once our team at the warehouse have processed your order, you will receive a second email to let you know that your order is on its way to you. If an email does not appear to have been received, please check your spam folder.

Can I make changes to my order?

Unfortunately, once you've placed your order, our warehouse team will have already started processing your order! Find out more info on our cancellation policy here.

Can I track my order?

Tracking your order is easy! Enter your 8 digit order number into the 'Track my order' facility at the top of this page.

Can I cancel my order?

To make sure you receive your items as fast as possible, we start processing your order as soon as we receive it. This means that once your order has been placed we cannot stop the process of items being sent to you , you will need to return the items to us.Find out more info on our cancellation policy here.

What should I do if I receive an incorrect or faulty item?

We're sorry to hear that you've received an incorrect or faulty item. Please send us a message with your order ID, the name/product code of the item you were supposed to receive and further details of the problem within 30 days of receiving your order. Please see 'How do I return an item?' for details on how to return an item to us.

Can I exchange an item?

Unfortunately, we are currently unable to process exchanges. You can return your item to us and place a new order to receive the item of your choice. Please return your item/items to us following the method below.

1.  Re-pack the item in its original packaging or in a secure, waterproof package with labels and tags still attached.

2.  Cover your address label with the boohoo returns label found on the bottom right of your delivery note.

3.  Return the package by using the Post Office counters and obtain proof of postage from the Post Office. Please do not post the package through the post box without obtaining a certificate of posting.

4.  Keep your certificate of postage safe as you will need this as your proof of return.

We now offer a FREE Collect+ Returns service where you can return your parcel at over 5,500 local convenience stores across the UK mainland and Northern Ireland.

Please follow the below process for returning your parcel to us when using our Collect+ service:

1.  Click here to generate your returns label and to find your nearest store.

2.  Re-pack the item in its original packaging with labels and tags still attached.

3.  Cover your address label with the boohoo.com address label found on the bottom right of your delivery note.

4.  Securely attach the Collect+ label to your parcel covering the original delivery label.

5.  Take your parcel to your local Collect+ store, where you'll receive proof of postage. Keep your certificate of postage safe as you will need this as your proof of return.

6.  You can then track your return using the code you were given here

Our UK delivery service includes England, Scotland, Northern Ireland and Wales, together with the Channel Islands, IOM, IOW and the Highlands and Islands of Scotland.

We also deliver to over 200 countries worldwide and currently offer an International Delivery Service which includes USA, Canada, New Zealand, Australia, United Arab Emirates and the following countries within Europe:

Do you deliver to PO BOXES & BFPO addresses?

PO Boxes – The delivery service we use for the United Arab Emirates will only be able to deliver to PO Box addresses, and cannot make deliveries to non PO Box addresses. The express delivery services for Australia, New Zealand and USA cannot make deliveries to PO Box addresses. Please use an alternative delivery address or select the standard delivery service. BFPO addresses - For delivery to BFPO addresses, please ensure that the delivery country selected is United Kingdom and do not write any other address details after the BFPO number on the address, as this can lead to mail being diverted to the wrong BFPO location. Please select the Next Day delivery option only. Please note: the parcel will not arrive with you next day, but will arrive at the BFPO sorting office the next day to be dispatched from there accordingly.

Will I be charged customs and import duties?

Depending on the value of your order, your boohoo parcel may or may not be charged customs or import duties. If your parcel is charged, it is up to the person receiving the parcel to cover these costs.

Unfortunately, these charges are out of boohoo’s hands, and vary widely from country to country, so we’re unable to predict what your particular charges may be. For more accurate information, we’d suggest getting in touch with your local customs office so you’re not surprised if there are any unexpected delivery charges at your end.

What time will my delivery arrive?

Deliveries can be made any time between 7.00am and 9.00pm.

What if I am not in when my parcel is delivered?

The delivery company may leave the parcel with a neighbour, or if there is a safe, secure location at the property they may leave the parcel there. The delivery company will leave a card saying that they have attempted to deliver the parcel, and provide you with details on where the parcel has been delivered to, how to contact them to re-arrange a delivery time or to advise where you can collect your parcel from. If you are a UK customer, please contact Customer Services via the Contact Us form on this page if you require further help in rearranging a delivery.

Will a signature be needed for my delivery?

If you or a neighbour is home to accept the delivery, then a signature will be required. If nobody is home to receive the parcel, then our carriers may attempt to leave it in a safe location. A card may be left to advise you of this, or to confirm that the parcel has been returned to the local depot. You can then contact the courier to arrange collection or to schedule a new delivery date that is more suitable for you.

Can you deliver to a different address than my billing address?

Yes! You can have your parcel delivered to another address. If you choose to have your parcel delivered to you at work, always make sure you put the name of the company or organisation in the address field, as well as the contact name to ensure your parcel is successfully delivered.

What if my parcel does not arrive?

We ask if you could patiently wait up to 4 days after the promised delivery date to receive your parcel in case of a delivery delay, but we will do our best to get your parcel to you as fast as we can. If you have still not received your order after this time, please contact us stating your order number and we will look into this for you.

RETURNS
How long do I have to return an item?

If you are a customer in the European Economic Area (EEA), you have a legal right to change your mind within 14 days and receive a refund for most products that you buy from us online. If you would like to cancel an order because you have changed your mind, you must tell us no later than 14 days after the date you receive the last of your items and you must return your items to us within 14 days of notifying us that you would like to cancel your order.

How long does it take to process my return?

It can usually take up to 7 working days (excluding weekends and bank holidays) from the date of your return for your parcel to be delivered back to our warehouse and processed.

On receiving your return the next step is for us to check the item(s). Once our checks are complete we’ll refund your credit/debit card. The funds should appear on your bank statement within 3-5 working days (how long depends on your card issuer).
If you paid for your order with a gift voucher or store credit, this will be credited back to your boohoo.com account.

We’ll make sure to keep you in the loop and send you an email as soon as your parcel arrives back at our warehouse, and again when we have processed your refund.

How can I track the status of my return?

We will send you an email as soon as your parcel arrives back at our warehouse, and again when we have processed your refund. Kindly note that it can take 3-5 working days for the payment to show on your account (depending on your card issuer) after the refund has been processed.

Do you refund the delivery charge?

We usually refund you what you paid for your order but not the delivery charge, unless your entire order was faulty or incorrect. If you live in the UK or European Union, and have cancelled your contract in accordance with the Consumer Contracts Regulations, we will also reimburse your delivery charges if you paid for delivery. Please bear in mind we’ll only reimburse the cost of the least expensive delivery option. Can I have an exchange instead of a refund?

I DON'T HAVE ACCESS TO A PRINTER SO HOW CAN I PRINT MY LABEL?

If you are unable to print the label provided via the returns portal then please simply write our address and your order number clearly on the outside of the parcel and insert a copy of your invoice in the parcel (this is very important to ensure we refund you!) and drop it off at the post office or with your choice of courier.

Please note: Free returns are only available if you use our returns portal and print your returns label. If you can’t print the label you will need to pay for the return and the charge will be dependent on the courier you use and the weight of the parcel, remember to ask for a receipt or proof of posting. You will still need to complete the information on the returns portal before posting your package back to us so we have all the information we need to process your return.

THE CONSUMER CONTRACTS REGULATIONS

If you’re a customer in the EEA, you get 14 days to cancel your contract with us. 1. OUR RETURNS POLICY

If you are a customer in the European Economic Area (EEA), you get 14 calendar days to cancel your order because you have changed your mind. This two week cancellation period starts from the day you have received all of the items in your order. Find out how to return your item(s) using our hassle-free, 3-step returns process here.

If you receive faulty goods, you may also have a right to return these goods and to ask us to repair or replace them or get a refund.



2. FAULTY GOODS

Please return your item(s) to us within 30 days after finding the fault, and remember to get in touch before returning. You can do this by filling out the form on our Customer Service Hub here , and a member of our team will look into it.

Please don’t use any faulty items after finding the fault, or we may not be able to provide a refund.



3. CANCELLING A CONTRACT UNDER THE CONSUMER CONTRACTS REGULATIONS

If you’re a customer in the EEA, you get 14 days to cancel your contract with us

This two week period starts from the day after you receive your order (or from the day after you receive the last item of your order). You’ll need to write to us with notice of your cancellation – just fill out this form where you’ll also find details on how to return your item(s).

Please ensure that lingerie and swimwear items are tried on over your own underwear. In the interest of hygiene, please do not remove the seal. If this is the case then we can reasonably decline your refund.

5. INTERNATIONAL RETURNS - HOW DO I RETURN AN ITEM OUTSIDE THE UK?

Please follow the process below for returning your parcel to us.

1. Re-pack the item in its original packaging or in a secure, waterproof package with labels and tags still attached.

2. Cover your address label with the boohoo returns label found on the bottom right of your delivery note, or download a new one from below.

3. Return the package by using your local Post Office counters and obtain proof of postage from the Post Office. Please do not post the package through the post box without obtaining a certificate of posting.

4. Keep your certificate of postage safe as you will need this as your proof of return. There is a returns label included in your parcel. If you have misplaced this label, you can download a new one below. Remember to add your order number if you download a new returns label. This can be found in Order History in 'My Account‘

7. HOW LONG DOES IT TAKE TO PROCESS MY RETURN?

It can usually take up to 7 working days (excluding weekends and bank holidays) from the date of your return for your parcel to be delivered back to our warehouse and processed.

On receiving your return the next step is for us to check the item(s). Once our checks are complete we’ll refund your credit/debit card. The funds should appear on your bank statement within 3-5 working days (how long depends on your card issuer).
If you paid for your order with a gift voucher or store credit, this will be credited back to your boohoo.com account.

We’ll make sure to keep you in the loop and send you an email as soon as your parcel arrives back at our warehouse, and again when we have processed your refund.



8. CAN I HAVE AN EXCHANGE INSTEAD OF A REFUND?

We don’t offer exchanges right now. You can return your item to us for a refund, and then place a new order to get the item of your choice. Find out how to return here – it’s as easy as 1, 2, 3!



9. I DON'T HAVE ACCESS TO A PRINTER SO HOW CAN I PRINT MY LABEL?

If you are unable to print the label provided via the returns portal then please simply write our address and your order number clearly on the outside of the parcel and insert a copy of your invoice in the parcel (this is very important to ensure we refund you!) and drop it off at the post office or with your choice of courier.

Please note: Free returns are only available if you use our returns portal and print your returns label. If you can’t print the label you will need to pay for the return and the charge will be dependent on the courier you use and the weight of the parcel, remember to ask for a receipt or proof of posting. You will still need to complete the information on the returns portal before posting your package back to us so we have all the information we need to process your return.

    6. A person who is not a party to this Contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Contract.
  11. INTELLECTUAL PROPERTY RIGHTS
    1. All and any Intellectual Property Rights in connection with the Products shall be owned by Us absolutely.
  12. INDEMNITY
    1. You agree to indemnify, defend and hold harmless Boohoo.com UK Limited, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from, without limitation, your breach of these terms and conditions, your infringement of any intellectual property right or any other right of any person or entity, or your breach of any duty of confidence or privacy, or any defamatory statements made by you in any form.
  13. IMPORT DUTY
    1. If you order Products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that We have no control over these charges and cannot predict their amount.     2. Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.
  14. WRITTEN COMMUNICATIONS

  15. NOTICES
    1. All notices given by you to us must be given to us at customerservices@boohoo.com . We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified in clause 13 above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.
  16. TRANSFER OF RIGHTS AND OBLIGATIONS
    1. The contract between you and us is binding on you and us and on our respective successors and assigns.
    2. You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.
    3. We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.
  17. EVENTS OUTSIDE OUR CONTROL
    1. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control ("Force Majeure Event").
    2. A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
      1. Strikes, lock-outs or other industrial action.
      2. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
      3. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster
      4. Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
      5. Impossibility of the use of public or private telecommunications networks.
      6. The acts, decrees, legislation, regulations or restrictions of any government.
    3. Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and We will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
  18. WAIVER
    1. If We fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
    2. A waiver by us of any default shall not constitute a waiver of any subsequent default.
    3. No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with clause 14 above.
  19. SEVERABILITY
    1. If any of these terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
    2. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause/sub-clause as is permitted by law.
  20. ENTIRE AGREEMENT
    1. These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of the Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
    2. We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions.
    3. Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other party’s only remedy shall be for breach of contract as provided in these terms and conditions.
  21. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS

We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities or for any other reason in our sole discretion which We may decide.

4.4.1. make further attempts to contact the Winner; and/or

4.4.2. withdraw the Prize from the Winner.

4.5 If the Prize is declined by a Winner or is withdrawn from a Winner by the Promoter under clause 3.4.2, the declining or forfeiting Winner will continue to be subject to the provisions of these Terms and Conditions; and the Promoter may offer the Prize to a alternate Winner selected by the Judges in accordance with this clause 4.

4.6 If any potential winner is found to be ineligible, or if he or she has not complied with these Terms & Conditions or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected.

5. Prize

5.1. The Winner will win:

– the Ibiza Getaway, provided by Thomas Cook Airlines, and consisting of: 2 return flights with Thomas Cook Airlines departing from either Manchester or London Gatwick to Ibiza during September or October 2016, excluding any school holidays; and four (4) night’s hotel accommodation for 2 people;

VIP club entry to one of the following clubs: Space, Sankeys, Zoo or Ushuaia and £200 (two hundred pounds) online store credit to spend at www.boohoo.com provided by the Promoter.

5.2. The flights must be booked by the winner by 31st August 2016 for a departure date in September or October 2016, excluding school holidays. Flights are subject to availability at all times. The hotel accommodation will be at least 3* and will be chosen by Thomas Cook Airlines entirely at their discretion and cannot be changed or altered in anyway by the winner. The winner must be one of the people travelling on the Ibiza Getaway.

5.3. The Store Credit will be credited to the Winner’s customer account on boohoo.com within 7 days of the Winner providing the Details – they will need to register an account at boohoo.com if they don’t already have one

5.4. The goods that may be purchased with the Store Credit are subject to availability and the Promoter will have sole discretion in this respect.

5.5. The Prize is non-transferable and non-refundable and the Winner cannot request any alternative prize (cash or otherwise), except in the Promoter’s discretion. Thomas Cook Airlines may award a substitute of comparable or greater value if the Ibiza Getaway listed becomes unavailable for any reason.

There is one (1) Prize available. The winner is permitted to ask a companion to accompany them, provided such other person is eligible for the prize in accordance with these Terms & Conditions and complies with any other requirements relating to the prize.

5.6. The Ibiza Getaway does not include travel insurance, or any other items or expense not specifically stated within the prize description. All such costs/expenses will be the responsibility of the winner and their travel companion. The winner and their travelling companion is responsible for ensuring they hold a valid passport to travel and any necessary visa, and hold the adequate travel insurance, as well as complying with any other terms and conditions applicable to the Ibiza Getaway and notified to the winner at the time of claiming the prize.

5.7. The Winner is responsible for all applicable local taxes, and for any other fees or costs associated with acceptance or use of the prize.

5.8. THE WINNER ACCEPTS THAT THE IBIZA GETAWAY IS NOT A ‘PACKAGE HOLIDAY’ FOR THE PURPOSES OF THE PACKAGE TRAVEL, PACKAGE HOLIDAYS AND PACKAGE TOURS REGULATIONS 1992 AND THE WINNER IS AFFORDED NO FINANCIAL PROTECTION OR OTHER RIGHTS UNDER THESE REGULATIONS.

6. Winner publicity

6.1. The Promoter and Thomas Cook Airlines reserves the right to publish the Winner’s name, photograph and town or county of residence on the Promoter’s and Thomas Cook Airline’s official social media accounts, including Twitter, Instagram and Facebook and on their websites found atwww.boohoo.com and www.thomascookairlines.com, and in all forms of media now known or hereafter developed for advertising and/or publicity purposes worldwide, in perpetuity, without further compensation except where prohibited by law.

7. Entry requirements

7.1. 8. Use and display of Entries and copyright

8.1. The copyright subsisting in the Entry must belong to the Entrant. Entrants will retain copyright in the Entries they submit. If an Entry contains reference to or images of a person, the consent of that person (or their parent or guardian if they are under 18) must have been obtained.

8.2. By submitting an Entry:

8.2.1. you license and grant the Promoter and Thomas Cook Airlines and their affiliates and sub-licensees an exclusive, royalty free, perpetual, worldwide, irrevocable and sub-licensable right to use, reproduce, modify, adapt, publish and display such content for any purpose in any media including, but not limited to the Promoter’s and Thomas Cook Airline’s websites, social media accounts, marketing materials, newsletters and promotional material without further compensation, restriction on use, attribution or liability;

8.2.2. you waive any moral rights or similar rights in respect of your entry to which you may be entitled (at the time of submission or in the future) under the Copyright, Designs and Patents Act 1988 as amended time to time or under any similar applicable laws in force from time to time in force anywhere in the world;

8.2.3. you warrant that the Entry is your original work, has not been copied, in whole or in part, from any third party and you have full authority to enter the Entry in the Prize Draw and to the rights granted in these Terms and Conditions;

8.2.4. you acknowledge that third parties will have access to and will be able to republish your Entry in accordance with the terms of use of the social media platform through which your Entry is submitted.

9. Liability

9.1.1. any Prize that is not redeemed;

11. General

11.1.The Promoter reserves the right to cancel or amend the Prize Draw or these Terms and Conditions if it has reasonable grounds for doing so. Any changes to the Prize Draw or these Terms and Conditions will be announced by the Promoter its website.

11.2.By entering the Prize Draw you accept these Terms and Conditions as in force at the time you submit your entry.

7.1. Except for death or personal injury caused by negligence of the Promoter or its agents or representatives or for fraud or fraudulent misrepresentation, neither the Promoter, nor its agents or representatives assume responsibility for:

7.1.1. any Prize that is not redeemed;

7.1.2. any personal property;

7.1.3. any loss of enjoyment or wasted expenditure;

7.1.4. any system failures or malfunctions of any third party websites;

7.1.5. any incomplete, lost, delayed or late Entries;

7.1.6. any failure to fulfil obligations of any third parties involved in this Prize Draw;

7.1.7. any fault, malfunction, damage, loss or disappointment suffered by the participants in the Prize Draw howsoever arising from participating in the Prize Draw;

7.1.8. communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this Prize Draw;

7.1.9. inaccessibility or unavailability of the internet, or any website (including without limitation any social media web sites) or any combination thereof through dial up, broadband, mobile internet or WAP connections;

7.1.10. any injury or damage to a participant which may be related to or arising from the Prize Draw or the Prize;

7.1.11. if for any reason the Prize Draw or any website in connection with the Prize Draw is not capable of running as planned for reasons which may include without limitation, infection by computer, virus, tampering, unauthorised intervention, fraud, technical failures or any other causes which may corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion; and/or

7.1.12. any other matter outside of their reasonable control.

7.2. Nothing in these Terms and Conditions affects your statutory rights.

7.3. To the extent permitted by law, all conditions, warranties and other terms which might otherwise be implied by statute or common law are expressly excluded from these Terms and Conditions.

7.4. The Winner agrees to indemnify and keep indemnified the Promoter, its group of companies and their officers, employees and agents from and against all liabilities, losses, damages and expenses (including legal and other professional fees) arising out of or in connection with any allegations or claims resulting directly or indirectly from:

7.4.1. their Entry into this Prize Draw; and/or

7.4.2. their receipt and use of any Prize.

8. General

8.1. The Promoter reserves the right to cancel or amend the Prize Draw or these Terms and Conditions if it has reasonable grounds for doing so. Any changes to the Prize Draw or these Terms and Conditions will be announced by the Promoter on the website.

8.2. By entering the Prize Draw you accept these Terms and Conditions.

8.3. Any person who provides their Details to the Promoter in connection with this Prize Draw:

8.3.1. accepts these Terms and Conditions; and

8.3.2. agrees that the Promoter may use their personal data: (a) for the purpose of administration of the Prize Draw (including publishing the name of the Winners and any administration relating to the Prize); and (b) any other purpose for which they have consented.

8.4. The use of any personal data by the Promoter shall be in accordance with the Promoter's Privacy Policy (which can be found on the Promoter’s website at http://www.boohoo.com/restofworld/privacy-policy/pcat/privacy and these Terms and Conditions.

8.5. Without prejudice to clause 6.1, the Promoter reserves the right to exclude any Entry from the Prize Draw (and withdraw any Prize that may have been awarded in respect of such Entry) if it deems it to be ineligible or otherwise invalid and the Promoter shall have complete discretion in this respect.

8.6. No responsibility can be accepted for lost Entries or incomplete Entries. Proof of Entry is not proof of receipt.

8.7. If any provision of these Terms and Conditions (or part of any provision) is found by any court or other competent authority to be invalid, unenforceable or illegal, the other provisions shall remain in force.

8.8. If any invalid, unenforceable or illegal provision would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with whatever modification is necessary to give effect to the commercial intention of the Promoter.

8.9. No failure or delay by a party to exercise any right or remedy provided under these Terms and Conditions or by law or any abandonment of any such right or remedy shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy.

8.10. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.

8.11. For the name of the Winners or for a copy of these Terms and Conditions please send a stamped addressed envelope together with your written request to ‘Premier Delivery Competiton’, Boohoo Marketing, 49-51 Dale Street, Manchester, M1 2HF.

8.12. The Prize Draw, these Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim which may arise out of or in connection with the Prize Draw or these terms.

TERMS & CONDITIONS RELATING TO BOOHOO’S ‘UNITE'S STUDENT COMPETITION’ PRIZE DRAW

The promoter of Boohoo & Unite’s Student Competition ("Prize Draw") is Boohoo.com UK Limited of 49-51 Dale Street, Manchester, M1 2HF (“Boohoo”) in conjunction with Unite Integrated Solutions PLC of The Core, 40 St Thomas Street, Bristol, BS1 6JX (“Unite ”) (together defined as the "Promoter").

1. Eligibility

1.1. This Prize Draw is open to individuals who, at the time of their entry in the Prize Draw, are:

1.1.1. resident in England or Scotland;

1.1.2. over the age of 18;

1.1.3. enrolled at a University and living in student halls of residence in one of the Cities (as defined below) during the 2016-2017 academic year, and

who will be enrolled to attend a University in one of the Cities during the 2017-2018 academic year.

1.2. The “Cities” are Aberdeen, , Birmingham, , Bristol, Coventry, Durham, Edinburgh, Exeter, Glasgow, Huddersfield, Leeds, Leicester, Liverpool, London, Loughborough, Manchester, Newcastle, Nottingham, Oxford, Plymouth, , Portsmouth, Reading, Sheffield and York.

1.3. Employees of the Promoter or any associated company and their immediate family, as well as sponsors of the Prize Draw and their employees, and judges of the Prize Draw and their immediate family, or anyone else involved in the organisation of the Prize Draw, may not enter the Prize Draw.

1.4. Entrants will require access to the internet to enter the Prize Draw.

1.5. Entrants must have their own active personal Instagram account to enter the Prize Draw.

1.6. Entrants must have their own www.boohoo.com customer account and their own personal Instagram account in order to enter the Prize Draw and claim the Prize (as defined below).

2. How to enter

2.1. To enter the Prize Draw, you must log in to your personal Instagram account and upload to Instagram a photo of you or your friends in the city where you are currently attending university and residing. You must tag @boohoo and @unite_student and include the hashtag #myboohoocity in your Instagram post ("Entry").
Only one Entry is permitted per person during the Prize Draw Period (defined below). If you make more than one Entry during the Prize Draw Period, only your first Entry will be counted.

2.2. Entries can only be made between 9.00am (BST) on 12 September and 8:00pm (BST) on 10 October ("Prize Draw Period").

2.3. Entries received outside of the Prize Draw Period will not be valid.

2.4. No bulk, third party or automated Entries are permitted.

2.5. All entrants (including the Winner) must comply with any reasonable directions given to him or her by the Promoter in connection with the Prize Draw. Failure to comply with such directions may result in an invalid Entry and/or withdrawal of the Prize.

3. Winner selection and contact

3.1. One (1) winning Entry will be selected at random at the end of the Prize Draw Period.

3.2. The Promoter will message the winning entrant on Instagram and ask the winning entrant (“Winner”) to provide the Promoter, via email to the email address provided by the Promoter, with details of their name, and email address ("Details"). Once the Winner has provided their Details in accordance with this clause, Boohoo will arrange for the ‘Boohoo wardrobe overhaul’ part of the Prize to be credited to the Winner’s personal www.boohoo.com account within 7 days and will contact the Winner to arrange the provision of the other parts of the Prize. Any correspondence regarding the Accommodation Prize will be with Unite (and Boohoo will provide suitable contact details to the Winner for Unite).

3.3. The selection of the Winner shall be final. No correspondence will be entered into in respect of any decision made in connection with this Prize Draw.

3.4. The Winner must provide the Details and have their own www.boohoo.com customer account and personal Instagram account in order to claim the Prize.

3.5. If any Winner fails to provide their Details to the Promoter, or does not set up a www.boohoo.com customer account, within 48 hours of the Promoter messaging the Winner on the Winner’s Instagram account asking them to provide the Details in accordance with clause 3.2, then the Promoter acting in its absolute discretion may:

3.5.1. make further attempts to contact that Winner; and/or

3.5.2. withdraw all or part of the Prize from that Winner.

3.6. If all or part of the Prize is declined by a Winner or is withdrawn from a Winner by the Promoter under these Terms and Conditions:

3.6.1. the declining or forfeiting Winner will continue to be subject to the provisions of these Terms and Conditions; and

3.6.2. the Promoter may offer that Prize to a new Winner selected in accordance with this clause 3.

3.7. Please note that if you delete your Entry from Instagram at any time, you will not be included in the draw for the Winner or in any further draws carried out pursuant to clause 3.6.

4. Prizes

4.1. The Winner will win the following Prize:

4.1.1. up to 1 year’s free accommodation in a single room in student halls of residence owned by Unite in one of the Cities (the “ Accommodation Prize”) (the exact length of the tenancy will depend on the standard tenancy length offered by Unite for the selected halls of residence). The maximum value of the Accommodation Prize will be £7,000 (subject to clause 4.4.4);

4.1.2. a Boohoo ‘wardrobe overhaul’ – boohoo will credit the Winner’s www.boohoo.com customer account in the amount of £300 (see clause 3.2 above);

4.1.3. free Domino’s pizza for a year! This amounts to one Domino’s pizza every month (including delivery to a location in one of the Cities) for twelve months (commencing in November 2016); and

4.1.4. an ultimate ‘hangover day’ for you and your friends at your current student halls of residence. This will involve Boohoo coming to visit your halls of residence in the 2016/2017 academic year (on a date to be agreed between Boohoo and your halls of residence) and providing Boohoo ‘hangover’ hoodies and other treats for up to 200 people.

4.2. The goods that may be purchased with the Boohoo ‘wardrobe overhaul’ Prize are subject to availability and the Promoter makes no guarantees as to the availability of any item at www.boohoo.com.

4.3. The Prize is non-transferable and non-refundable and Winners cannot request any alternative prize (cash or otherwise).

4.4. As regards important information relating to the Accommodation Prize:

4.4.1. it is only valid for tenancy agreements starting in September 2017;

4.4.2. the tenancy length will depend on the halls of residence chosen by the Winner;

4.4.3. the Winner must notify Unite as soon as possible of the halls of residence for which they would like to claim the Accommodation Prize (the Winner can secure their room booking from 4 November 2016). All halls of residence owned by Unite are subject to availability and delay in notifying the Promoter of the chosen property may lead to disappointment;

4.4.4. the maximum rental value of the Accommodation Prize will be £7,000 (but no cash or additional prize will be provided if the value of the Accommodation Prize chosen is below this amount). If the Winner wishes to choose a room with a rental value above this amount, the Winner must pay any excess above this amount. (This clause 4.4.4 shall not apply in respect of any City in which Unite does not offer a room in a student halls of residence for the 2017/18 academic year for £7,000 or less);

4.4.5. in order to claim the Accommodation Prize and secure the Winner’s chosen room, the Winner will need to sign and agree to Unite’s student tenancy terms and conditions (please see http://www.unite-students.com/legal-booking for further information) and provide a guarantor who will also need to agree to these terms and conditions and sign a guarantor agreement. The Winner will also be required to pay a security deposit (which will be refundable subject to the applicable security deposit terms and conditions).

5. Winner publicity

5.1. The Promoter reserves the right to publish the Winner's name and Entry on the Promoter’s official social media accounts, including Twitter, Instagram and Facebook and on its website found at www.boohoo.com.

5.2. The Promoter reserves the right to disclose the name and county of the Winner in response to requests submitted under clause 9.12.

5.3. By entering the Prize Draw, you agree (if you become a Winner) to your Entry being published in accordance with clauses 5.1 and 5.2 and to take part in and co-operate fully with all reasonable publicity accompanying or resulting from this Prize Draw without further recompense.

6. Entry requirements

6.1. Any Entry that is deemed by the Promoter, in its sole discretion, to be unlawful, obscene, vulgar, pornographic, hateful, threatening, discriminatory, offensive, or which may otherwise bring the Prize Draw or Promoter into disrepute, or which does not comply with Instagram’s terms of use or these Terms and Conditions, will be excluded from the Prize Draw and the Promoter reserves the right to take any further action in respect of such Entry that it deems appropriate (including without limitation the withdrawal of any Prize awarded to that entrant).

6.2. The Promoter will fully co-operate with any law enforcement authorities or court order requesting or directing the Promoter to disclose the identity of or to locate anyone posting or linking any content to its Instagram page which infringes any third party rights or is in breach of any of these Terms and Conditions, Instagram’s terms of use or any applicable law.

The Prize Draw, these Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim which may arise out of or in connection with the Prize Draw or these terms, except that if you live in Scotland you can bring legal proceedings in either the English courts or the Scottish courts.

TERMS & CONDITIONS RELATING TO BOOHOO’S ‘ON THE BEACH KIDS COMPETITION’ PRIZE DRAW

THIS AGREEMENT is made 2016

1. BRIEF: launch a competition to win ‘a trip to the 4* sol katmandu park & resort to celebrate the launch of boohoo’s kids wear range’

The Competition will enhance content, cross brand awareness, social media presence and increase database size for both parties.

BETWEEN

(1) On the Beach Ltd

(2) Boohoo.com UK Ltd. Incorporated and registered in England and Wales with company number 05723154 whose registered office is 49-51 Dale Street, Manchester, M1 2HF (“Boohoo”).

Background

- On the beach will provide: - Return flights from any UK airport to Palma Airport for up to a family of 4, consisting of a maximum of 2 adults.

- 1 bag per traveller, up to a maximum of 4 bags. Weight of luggage is to be in accordance with airline guidelines.

- A 5 night stay on a half board basis in a family room which sleeps 4 people at the 4* Sol Katmandu Park & Resort in Magaluf, Majorca.

- In-resort transfers will be included. The flights are for travel before 30 September 2017, including any school holidays.

- Online store credit redeemable only at www.boohoo.com up to the value of £500 and to be provided by Boohoo.

The Competition is open to residents of the UK only, aged 18 years or over.

Both parties to support the promotion as outlined in Section 2 (the “Promotion”).

Agreed Terms

1 Engagement & PERFORMANCE

1.1 On the Beach and Boohoo to promote the Competition as outlined in Section 2.

1.2 The Competition shall commence on 3rd Oct 2016 at 12.00AM Greenwich Mean Time (GMT) and ends on 17th Oct 2016 at 11.59PM GMT (the “Competition Period”).

1.3 On the Beach and Boohoo will conduct the Promotion of the Competition to a reasonable standard. Both parties will at all times conduct themselves in a polite and professional manner and do nothing to reflect negatively or injure the reputation of either brand.

1.4 Both On the Beach and Boohoo accept that they have a brand image and reputation to protect and hereby agree, on request from either party to amend or remove any content which On the Beach or Boohoo, at their absolute discretion, believes will or may have a detrimental effect on their reputation and goodwill.

1.5 On the Beach will defend, indemnify and hold Boohoo and each of its officers, employees, affiliates and agents harmless against and from all claims, suits, judgments, losses, damages, fines or costs (including reasonable attorney’s fees and expenses) resulting from any claim relating to the On The Beach Arranged Holiday Prize. On the Beach’s obligations under this paragraph will survive the termination of this agreement.

1.6 Liability under the indemnity in clause 1.5 is conditional on Boohoo discharging the following obligations. If any third party makes a claim, or notifies an intention to make a claim, against Boohoo which may reasonably be considered likely to give rise to a liability under this indemnity (a “Claim”), Boohoo shall:

1.6.1 as soon as reasonably practicable, give written notice of the Claim to On the Beach, specifying the nature of the Claim in reasonable detail;

1.6.2 not make any admission of liability, agreement or compromise in relation to the Claim without the prior written consent of On the Beach;

1.6.3 give On the Beach and its professional advisers access at reasonable times (on reasonable prior notice) to its premises and its officers, directors, employees, agents, representatives or advisers, and to any relevant assets, accounts, documents and records within the power or control of Boohoo, so as to enable On the Beach and its professional advisers to examine them and to take copies (at On the Beach expense) for the purpose of assessing the Claim; and

1.6.4 be deemed to have given to On the Beach sole authority to avoid, dispute, compromise or defend the Claim

1.7 Boohoo will defend, indemnify and hold On the Beach and each of its officers, employees, affiliates and agents harmless against and from all claims, suits, judgments, losses, damages, fines or costs (including reasonable attorney’s fees and expenses) resulting from (1) any breach by Boohoo of its obligations, express or implied, under this Agreement; or (2) any claim relating to the those elements of the Prize to be provided by Boohoo. Boohoo’s obligations under this paragraph will survive the termination of this Agreement.

2 PROMOTION

2.1 ARTWORK:

Boohoo to provide landing page for the Competition to sit on.

Each party shall indemnify and hold harmless the other party from and against all costs, claims, demands, liabilities, expenses, damages or losses suffered or incurred by either party arising from any claims (and/or proceedings) that the other party has infringed any third party intellectual property rights as a results of its use of either party’s intellectual property (provided such use is in accordance with the terms of this Agreement).

Boohoo permits On the Beach to use Boohoo’s brand logos, establishment’s name, benefit offer and trademark(s) (the “Boohoo Content”) in the Promotion advertising for this Competition, subject to the following conditions:

i. Any use of the Boohoo Content will be presented to Boohoo prior to being published;

ii. The use of Boohoo’s Content is restricted to the duration of this Competition and shall not be used for any other purpose outside of this agreement without the prior permission of Boohoo;

iii. Nothing in this agreement shall be construed as conferring upon On the Beach any right or interest in Boohoo’s intellectual property. On the Beach will comply with Boohoo’s reasonable instructions as to the use of Boohoo’s Content and not to do anything that might jeopardise their validity or registration.

On the Beach permits Boohoo to use On the Beach brand logos, establishment’s name, benefit offer and trademark(s) (the “On the Beach Content”) in the Promotion advertising for this Competition, subject to the following conditions:

i. Any use of the On the Beach Content will be presented to On the Beach prior to being published;

ii. The use of the On the Beach Content is restricted to the duration of this Competition and shall not be used for any other purpose outside of this agreement without the prior permission of On the Beach;

iii. Nothing in this agreement shall be construed as conferring upon Boohoo any right or interest in On the Beach’s intellectual property. Boohoo will comply with On the Beach’s reasonable instructions as to the use of the On the Beach Content and not to do anything that might jeopardise their validity or registration.

2.2 EMAIL:

i. On the Beach to promote the competition via two email communications (slices) to their UK database via email communication

ii. Boohoo to promote to their UK database via four email communications (slices) and one solus postcard email

2.3 SOCIAL MEDIA:

On the Beach to provide ten social media updates promoting the competition as follows:

4 x posts on the official On the Beach Facebook page;

6 x posts on the official On the Beach Twitter account.

In social media communications, On the Beach agrees that any mention of Boohoo will be tagged with @boohoo or relevant social handles.

Boohoo to provide 6 social media updates promoting the Competition as follows:

2 x posts on the official Boohoo Facebook page;

4 x posts on the official Boohoo Twitter account.

In social media communications, Boohoo agrees that any mention of On the Beach will be tagged with @OntheBeachUK or relevant social handles.

2.4 ONCE COMPETITION CLOSED:

Once the Competition is closed Boohoo shall email to all entrants who have been unsuccessful, promoting an exclusive % discount code for www.boohoo.com.

For the avoidance of doubt the % discount, and nature of it, offered by Boohoo under this clause is to be determined at the sole discretion of the party giving such discount.

3 LOGISTICS

3.1 Boohoo.com to host and administer the Competition on their Website, www.boohoo.com/competition (the “Website”), with data capture field to form entry (the “Entry Form”) In a form to be agreed between the parties.

3.2 Before the Competition is launched the parties are to agree the format and content of the competition terms and conditions which are to bind each and every entrant (the “Competition T&Cs”). The parties agree that the contract with each Entrant shall shall be between them and Boohoo and this shall be as stated in the Competition T&Cs. Boohoo warrants it will comply with any and all its obligations under such Competition T&Cs. The parties agree that the form of the Competition T&Cs shall be that attached at Schedule 1 to this Agreement.

3.3 Boohoo is, as host, solely responsible for ensuring that it suitably incorporates the Competition T&Cs into its contract with each and every entrant to the Competition.

3.4 In hosting and administering the Competition Boohoo agrees that it shall comply with all applicable laws and shall ensure its Website is at all times compliant with all applicable laws. Furthermore, in promoting the Competition, Boohoo agrees to comply with all applicable advertising laws and regulations, including but not limited to any guidance from the Advertising Standards Authority and the CAP Code. Boohoo further agrees to ensure the Website is available at all times (as far as is reasonably possible) and shall provide reasonable notice to On the Beach of any Website downtime or scheduled maintenance.

3.5 Data fields utilised on the entry form include: Title, First name, Last name, Email, Telephone (“Personal Data”).

3.6 On entering the competition the entrant will consent to receiving future marketing communication from both On the Beach and Boohoo.

3.7 Full data capture information to be provided to On the Beach from Boohoo by 21st October 2016. The fields of information to be provided shall be the same as those contained in clause 3.5 of this agreement.

3.8 Boohoo.com to pick the winner of competition by 21st October 2016. The winner will be notified by e-mail. The winner then has 48 hours to respond to the email. Should the winner fail to respond to Boohoo within 48 hours of the email, then On the Beach and Boohoo acting in its absolute discretion may:

3.8.1 Make further attempts to contact the winner; and/or

3.8.2 Withdraw the prize from the winner.

3.9 If the prize is declined by the winner or is withdrawn from the winner under clause 3.8.2:

3.9.1 The declining or forfeiting winner will continue to be subject to the provisions of the Competition T&Cs; and On the Beach and Boohoo may offer the prize to a new winner.

3.10 On acceptance of the prize by the winner, the flights and hotel will be booked with the assistance of On the Beach. The flights are for travel before 30 September 2017, including any school holidays. Flights must be booked by the winner by 1 December 2016. . Boohoo will thereafter provide details to the winner for redemption of the store credit.

3.11 The winner will win online store credit redeemable only at www.boohoo.com up to the value of £500 and to be provided by Boohoo.

3.12 The Prize will be credited to the winner’s customer account on boohoo.com within 7 days of the winner providing their details to Boohoo (the “Details”).

3.13 The goods that may be purchased with the store credit are subject to availability and Boohoo will have sole discretion in this respect.

3.14 In respect of the holiday, On the Beach agrees to provide the following:

- Return flights for up to a family of 4 departing from any UK airport to Palma within the next 12 months including any school holidays. Flights must be booked by the winner by 1st December 2016.

– 5 night’s hotel accommodation in a family room at the 4* Sol Katmandu Park & Resort

-In resort transfers

3.15 The prize is non-transferable and non-refundable and the winner cannot request any alternative prize (cash or otherwise).

3.16 On the Beach are only responsible to the winner for the provision of the prize as listed at clause 3.15. However, On the Beach reserves the right to award a substitute of comparable or greater value if the hotel listed becomes unavailable for any reason.

3.17 The winner must be one of the people travelling on the trip. All flights are subject to availability.

3.18 The prize does not include travel insurance, or any other items or expense not specifically stated within the prize description. All such costs/expenses will be the responsibility of the winner and their family. The winner and their travelling companions are responsible for ensuring they hold a valid passport to travel and any necessary visa, and hold the adequate travel insurance, as well as complying with any other terms and conditions applicable to the prize and notified to the winner at the time of claiming the prize.

3.19 The winner is responsible for all applicable local taxes, and for any other fees or costs associated with acceptance or use of the prize.

3.20 The parties accept that the prize is not a ‘Package Holiday’ for the purposes of the Package Travel, Package Holidays and Package Tours Regulations 1992 and the winner is afforded no financial protection or other rights under these regulations.

4 SCHEDULE OF PROMOTION

4.1 Competition to launch on 3rd October 2016 at 12.00AM Greenwich Mean Time (GMT).

4.2 Competition closes on 17th October 2016 at 11.59PM GMT.

5 CANCELLATION AND TERMINATION

5.1 Whether or not this Agreement has been terminated, except as expressed elsewhere neither party shall be liable to the other for failure to perform obligations under this Agreement nor for any loss, damage or delay resulting from, but not limited to, an Act of God, fire or flood, riot or industrial dispute, legal restrictions or any matter outside of the control of the parties (“Force Majeure Event”).

5.2 The party affected by a Force Majeure Event shall promptly give written notice of the nature and likely duration (if it can be assessed) of the Force Majeure Event.

5.3 Should any Force Majeure Event continue for a period of 7 (seven) days or more, either party shall be entitled to terminate this Agreement forthwith and the provisions of this Agreement relating to the consequences of termination shall thereupon take effect.

5.4 Both parties shall be entitled to terminate this Agreement, with immediate effect, should they decide, at their absolute discretion, that either party has (whether before or after the date of this Agreement) done anything or is associated with anything which would be likely to bring On the Beachor Boohoo into disrepute or otherwise damage the reputation and goodwill.

6 CONFIDENTIALITY AND PUBLICITY

6.1 The parties agree that each party will not disclose, or authorise the disclosure of, the terms of this Agreement, any matter relating to any of the terms of this Agreement or any other confidential information relating to the operations or business of either party to any other person, except to its advisors or as it may be required to do so by law.

6.2 On the Beach and Boohoo hereby agree to refer all enquiries from third parties concerning the Competition or engagement under this agreement to Emily Whitehouse (On the Beach Marketing Exec) or Holly Marriott (Boohoo Marketing Exec).

7 DATA PROTECTION

7.1 Both parties shall ensure that all data which is collected and processed in connection with the Competition and all data transferred from Boohoo to On the Beach in connection with the Competition, is collected, processed and transferred in compliance with Data Protection Legislation. The measures taken by both parties to ensure such compliance shall include the placement on the competition website page and in the competition entry form, of:

7.1.1 A clear statement that by entering the Competition, entrants consent to receive marketing communications from both Boohoo and On the Beach;

7.1.2 A clear statement that the Competition T&C’s will apply to all entries to the Competition; and

7.1.3 the full text of the Competition T&C’s or a link to, or the URL of a webpage on which entrants can find the full text of Competition T&C’s.

7.2 On the Beach will only send marketing communications promoting the Competition directly to individuals on On the Beach’s UK database and entrants who have consented to receiving future marketing communication from On the Beach. On the Beach will ensure that all such communications are sent in accordance with all Data Protection Legislation and that it has all the relevant consents to do so.

7.3 Boohoo will only send marketing communications promoting the Competition directly to individuals on Boohoo’s UK database and entrants who have consented to receiving future marketing communication from Boohoo. Boohoo will ensure that all such communications are sent in accordance with all Data Protection Legislation and that it has all the relevant consents to do so.

7.4 Both parties warrant that it shall:

7.4.1 Process the Personal Data only to the extent, and in such a manner as is necessary for the provision of the services in this agreement and shall not process the personal data for any other purpose;

7.4.2 Promptly comply with any request from either party requiring the other party to amend, transfer or delete the Personal Data;

7.4.3 Take reasonable steps to ensure the reliability of any of its employees who have access to the Personal Data;

7.4.4 If it receives any complaint, notice or communication which relates directly or indirectly to the processing of Personal Data or to either party’s compliance with the Data Protection Act 1988 and the data protection principles set out therein, immediately notify the other party providing full details. Each party is to provide full co-operation and assistance in relation to any such complaint, notice or communication;

7.4.5 Promptly inform the other party if any Personal Data is lost or destroyed or becomes damaged, corrupted or unusable;

7.4.6 Notify the other party within three (3) working days if it receives a request from a data subject for access to that data subject’s Personal Data;

7.4.7 Not disclose the Personal Data to any data subject or to a third party other than at the request of the other party or as provided for within the agreement;

7.5 Both parties shall ensure that access to the Personal Data is limited to those of its employees who need access to the Personal Data to meet the obligations under this agreement. Such employees are subject to the obligations under this agreement. Both parties agree to indemnify and keep indemnified and defend at its own expense the other party against all costs, claims, damages, losses, liabilities, fines, penalties or expenses (including legal fees and expenses) incurred by either party or for which either party may become liable arising from any failure by the other party or its employees, agents or sub-contractors to comply with either of the parties obligations under this agreement.

7.6 Neither party shall assign, charge, transfer, delegate, sub-contract or otherwise dispose of, in whole or in part, any of its rights or obligations under this agreement without the prior written consent of the other party.

8 GENERAL

8.1 This Agreement, including the Schedules constitutes the entire agreement between the parties relating to the matters set out in this Agreement and cannot be altered except in writing signed by both parties.

8.2 No failure or delay by either party to exercise any right or remedy provided under this agreement or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.

8.3 A person who is not a party to this agreement shall not have any rights under or in connection with it.

8.4 This Agreement will be governed by and construed in accordance with the laws of England and Wales and the parties submit to the exclusive jurisdiction of the English Courts.

COMPETITION TERMS AND CONDITIONS

1 By entering this competition you will be added into the On the Beach & boohoo marketing database and may be sent relevant news and offers. You may opt out at any time.

2 The competition is open to Great Britain (England, Wales, Scotland and Northern Ireland – excluding Ireland), the Channel Islands or the Isle of Man only. Entrants must be aged 18 years or over. Employees of Boohoo.com UK Ltd (“Boohoo”) and On the Beach Ltd ( “On the Beach”) (together the “Promoters”), their families, agents or any third party directly associated with administration of the competition may not participate. The Promoters reserve the right to refuse any entry that is believed to be in breach of the Terms and Conditions.

3 The competition is free to enter and no purchase is necessary

4 All entries must be submitted via www.boohoo.com /competition and only one entry per person is permitted. Entry is made by submitting a name and email address on the above page.

5 The opening date for entries is 12.00 AM GMT on 3rd october 2016. The closing date of the competition is 11.59 PM on 17th October 2016. Entries received after this time will not be considered.

If the prize is declined by the winner or is withdrawn from the winner, then the declining or forfeiting winner will continue to be subject to the provisions of this the Competition Terms and Conditions.

If you’re looking for actual cookies, we thought we’d treat you to an easy recipe to save you from being too disappointed. Happy baking!

You’re going to need:

  • - 350g self-raising flour
  • - 225g salted butter
  • - 350g brown sugar
  • - 1 tsp vanilla extract (not essence, yuk!)
  • - 1 tsp cinnamon
  • - 2 eggs
  • - 400g dark/milk chocolate chips
  • - Baking parchment

    1)  Stir together the flour, baking soda, cinnamon and salt.
    2)  In a separate bowl, beat together the butter, white sugar, brown sugar and vanilla extract.
    3)  To this mixture add the eggs one at a time and beat the mixture in-between.
    4)  Slowly stir in the flour.
    5)  Stir in the chocolate (try not to eat all the chocolate chips, they taste better in the cookies, we promise!)
    6)  Roll the dough into a log shape (if you have time, wrap the log in cling film and leave in the fridge overnight, it will make your cookies extra delicious!)
    7)  Slice into 2cm thick disks.
    8)  Place your little disks onto a baking tray with some baking parchment (if you really want to make your cookies taste fabulous, sprinkle a tiny bit of sea salt over them at this point. Sounds crazy I know but you need to trust us on this!)
    9)  Bake for 10 minutes, rotating the baking parchment after 5 minutes.
    10)  Wait for them to cool a little before transferring to a wire rack, if you can’t wait (we never can) go ahead and eat them whilst they are still warm!
